Las Vegas Mental Health Clinics Face Challenges After State Inspections Resume

State inspections have resumed at Moriah Behavioral Health and its subsidiaries, Ignite Teen Treatment LLC and Eden Treatment LLC, located in the Las Vegas area. This follows a ruling from District Judge Jennifer Schwartz on November 20, 2023, which dissolved a temporary restraining order that had previously prevented the Nevada Department of Human Services and the Nevada Health Authority from conducting what the clinics claim are unlawful and overly broad searches.
Attorney Mark Hutchings, representing the clinics, filed a 48-page complaint on November 3, alleging that these state inquiries have resulted in retaliatory sanctions that disrupt patient intakes and threaten the clinics' ability to maintain licensing and receive Medicaid funding.
Hutchings expressed that the ruling has caused significant financial harm to the clinics. The lawsuit names multiple defendants, including the Nevada Health Authority, its director Stacie Weeks, and social services chief Michael Gorden, along with the Nevada Department of Human Services and its director Richard Whitley.
State inspectors have reportedly conducted unannounced visits to Moriah facilities from late 2024 to mid-2025, demanding access to staff, patients, and records without providing a clear purpose for their visits.
During the November 20 hearing, Hutchings argued that these tactics violate the Fourth Amendment, which protects against unreasonable searches. However, Deputy Attorney General Abigail Pace countered that the state agencies are enforcing regulations to ensure compliance and safety for licensed medical facilities.
She noted that Moriah had previously accepted these regulatory terms when seeking a license in Nevada. Weeks, the director of the Nevada Health Authority, stated that the agency is pleased with the court's ruling, emphasizing the priority of ensuring safe and quality care for vulnerable children served by these facilities.
Hutchings, however, claims there have been no complaints against his clients regarding care deficiencies. He criticized the state's practice of executing general warrants, which he says allow them access to all areas of the facilities and personal records without justification.
The restructuring of Nevada's health services into the Nevada Health Alliance and the Department of Human Services in July 2023 has added complexity to the situation. Hutchings warns that the ongoing state actions could lead to the closure of Moriah and its subsidiaries, affecting their operations not only in Nevada but also in Illinois, Iowa, and beyond.
As the conflict continues, the future of mental health services in the region hangs in the balance.
