Trump Seeks Supreme Court Review of E. Jean Carroll Verdict
Full Transcript
Former President Donald Trump has requested the U.S. Supreme Court to overturn a jury's verdict that found him liable for sexually abusing and defaming writer E. Jean Carroll. According to the New York Times, Trump’s legal team filed a petition arguing that the assertions against him were implausible and unsubstantiated.
They claimed that the trial court made a series of indefensible evidentiary rulings that unfairly favored Carroll’s case. Trump's lawyers also referred to the lawsuit as part of a politically motivated campaign against him, labeling it as 'liberal lawfare.' In the 2023 trial, Carroll testified that Trump turned a friendly encounter into a violent attack in a dressing room at Bergdorf Goodman, a luxury retailer in Manhattan, during the mid-1990s.
The jury awarded Carroll $5 million in damages, which included a finding of defamation due to Trump's comments made in October 2022 denying her allegations. The Guardian reported that Trump’s lawyers, led by attorney Justin D.
Smith, accused the trial judge, Lewis A. Kaplan, of warping federal evidence rules to bolster Carroll's claims. The filing emphasized that there was no physical or DNA evidence supporting Carroll's allegations, and they argued that the jury’s findings were based on inflammatory testimony.
Trump's lawyers previously appealed to the Second U.S. Circuit Court of Appeals, which upheld the original verdict. They asserted that this ruling conflicted with how evidentiary rules should be applied in other federal appeals courts.
The appellate court had also allowed two other women to testify about their similar allegations against Trump, which his legal team contended compounded the trial's unfairness. In September, when Trump’s lawyers first indicated their intent to appeal to the Supreme Court, Carroll's lawyer expressed skepticism, stating they did not believe Trump would present any legal issues warranting Supreme Court review.
Trump's legal team emphasized that the Supreme Court, with its current conservative majority, might be more receptive to his arguments. The Washington Post noted that Trump has had some successes in legal battles recently, such as a New York appeals court throwing out a significant penalty in a separate civil fraud lawsuit.
The stakes of the Supreme Court's potential intervention in the Carroll case could have far-reaching implications for Trump's political future, particularly as he continues to campaign for the Republican nomination for the 2024 presidential election.
The complex legal landscape surrounding Trump's ongoing battles, including this case, could significantly influence public perception and his support base as he navigates his political ambitions. As such, the outcome of this Supreme Court appeal could resonate well beyond the courtroom, shaping the narrative of Trump's ongoing legal troubles and his campaign strategy moving forward.
